1. Parties and acceptance
These terms of use ("Terms") govern access to and use of the website at playtestyour.games (the "Site"), its application programming interface (the "API") and the Playtest HUD desktop application (the "Application", and together with the Site and the API, the "Service"). The Service is operated by the operator of playtestyour.games ("we", "us", "our").
By accessing or using the Service, or by registering an account, you agree to be bound by these Terms. If you do not agree to them, you must not use the Service.
2. Eligibility and accounts
- You must be at least 13 years of age, and of sufficient age to form a binding contract in your jurisdiction. Where applicable law prescribes a higher minimum age for the use of online services, that age applies.
- Accounts are personal to the registered user. You are responsible for maintaining the confidentiality of your sign-in link and of any API key issued to you, and you are responsible for all activity conducted under your account.
- We may suspend or terminate an account used to distribute unsolicited material, to harass any person, to circumvent a prior suspension, to manipulate ratings, or to submit content in breach of section 3.
3. User content and conduct
You are solely responsible for the content you submit to the Service, including reviews, ratings, comments, responses, images, video clips and game listing details ("User Content").
You must not submit User Content that:
- is unlawful, defamatory, harassing, or infringes the privacy of any person;
- infringes the intellectual property rights of any person, including footage, artwork or text you are not authorised to distribute;
- misrepresents the authorship or origin of a game, of gameplay footage or of a review; or
- constitutes a rating not based on genuine use of the game reviewed.
Critical assessment of a game is permitted, including assessment that is unfavourable. Content directed at an individual rather than at the game under review is not permitted and will be removed.
4. Ownership and licence granted to us
As between you and us, you retain all right, title and interest in your User Content. Nothing in these Terms operates as an assignment of copyright.
You grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, adapt for the purposes of display (including resizing, transcoding, excerpting and generating thumbnails), publish, communicate to the public and display your User Content:
- on and through the Service, including the API and the Application;
- in material promoting the Service, including articles, newsletters, social media posts, promotional screenshots and press materials, with attribution to your handle where practicable; and
- for the purposes of statistical analysis, research and derived works produced in accordance with section 5.
You represent and warrant that you hold all rights necessary to grant this licence in respect of all User Content you submit, including any third-party material contained in it.
5. Analytics and promotional use
We may retain, process and analyse ratings, reviews, comments, game listings and usage data for the purposes of operating and improving the Service, and we may publish the results of that analysis. Published results may include, without limitation, the volume of games reviewed in a period, the distribution of scores across the playability, aesthetics and originality categories, activity by genre or platform, typical session duration and comparative movement in scores.
- Aggregated and derived data. Statistics and other data derived from multiple games, reviews or sessions may be retained and published by us indefinitely, including following the removal of a listing, review or account. Deletion of User Content does not require us to recalculate or withdraw any analysis previously published.
- Excerpts and attribution. Excerpts of User Content, scores and screenshots may be reproduced in promotional material under the licence in section 4, with attribution to your handle. You may request that a specified excerpt not be used in promotional material published after the date of your request, and we will comply with that request; we are not obliged to withdraw material already published or distributed by third parties.
- No sale of data. We do not sell User Content or personal data, and we do not disclose either to advertisers or data brokers. Our processing of personal data is governed by the privacy policy.
6. Game listings
A registered user may submit a link to a publicly available game, and we may create listings from links published in public discussion threads inviting feedback. A listing comprises the title of the game, a link to it, artwork obtained from its store page, descriptive tags, and the reviews and comments submitted by users. A listing does not indicate that the developer or publisher requested it, endorsed it, or agrees with any statement contained in it.
The owner of a listed game may claim the listing, which permits that owner to respond to each review and to request a further review following changes to the game. The owner may also require removal of the listing in accordance with section 7.
7. Removal of listings, content and accounts
7.1 Undertaking. Where you are the owner of a game listed on the Service, we will remove the listing for that game upon verification of your ownership. You are not required to state a reason for the request, and we will not require you to justify it.
7.2 Form of request. A request is validly made by either of the following methods, each of which constitutes a formal request for the purposes of these Terms:
- submission of the request through the Service from the account holding an approved ownership claim in respect of the game; or
- notice in writing sent by electronic mail to [email protected], from an address published on the store page, website or publisher account associated with the game.
7.3 Verification of ownership. Ownership may be verified by any means sufficient to satisfy a reasonable person, including publication of a verification code issued by us on the store page or on a channel under your control, correspondence from a domain used by the game, or a message sent from the account that publishes it. We will identify the least burdensome method available in the circumstances.
7.4 Effect and timing. Within 7 days of verification we will remove from public access the listing together with the reviews, comments and responses associated with it, and confirm to you that removal has been effected. Where we consider that a listing is being used to harass the requesting party, we will effect removal without delay and complete verification subsequently.
7.5 Personal data. The methods in section 7.2 apply equally to closure of an account and erasure of personal data. The scope of erasure, and the categories of data retained following it, are set out under your rights in the privacy policy.
7.6 Limitation. For the avoidance of doubt, this section does not extend to aggregated or derived data previously published in accordance with section 5, or to copies of publicly accessible pages made or retained by third parties, neither of which is within our control.
8. Moderation
Certified reviewers and administrators assess submissions to the Service. We reserve the right to hide, reject or remove any User Content or listing that breaches these Terms, and any listing whose associated game has become unavailable or presents a risk to users. We will ordinarily notify the affected party of a removal and the reason for it. Nothing in these Terms obliges us to publish or continue to publish any particular game, review or comment.
9. The Application
The Application records play sessions locally on your device. Session recordings are not transmitted to us. Only the highlight clips you elect to attach to a review, together with the review itself, are transmitted to the Service. The Application authenticates to the API using an API key issued to you, which you may revoke at any time from your account settings.
10. Disclaimer and limitation of liability
The Service is provided on an "as is" and "as available" basis. Ratings and reviews published on the Service are the opinions of the users who submitted them. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not warrant that the Service will be uninterrupted, complete or free from error.
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with the Service. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you contract as a consumer, your statutory rights are not affected.
11. Amendments, governing law and contact
We may amend these Terms from time to time. The date stated at the head of this page indicates the date of the current version. Amendments that materially affect User Content already submitted will be notified on the Service before they take effect. Continued use of the Service following the effective date of an amendment constitutes acceptance of the amended Terms.
These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of the jurisdiction in which the operator is established, and the courts of that jurisdiction have exclusive jurisdiction, save that a consumer may bring proceedings in the courts of the jurisdiction in which that consumer is domiciled where applicable law so provides.
